ARTLAS USER AGREEMENT

Our mission is to empower the art community by connecting artists, galleries, collectors, and art enthusiasts, enabling them to be more productive and successful. Our services are designed to foster economic opportunities for our members by facilitating connections, idea exchanges, learning opportunities, and discovery of work and collaborations within a network of trusted relationships.

Introduction

Contract

By using our Services, you're agreeing to these terms, including our Privacy Policy, which explains our data handling practices. Your interaction with ARTLAS, through joining, registering, accessing, or using our services, signifies entering into a legally binding contract with ARTLAS. If you disagree with any part of this contract, please do not use our Services. You can terminate this contract at any time by closing your account and ceasing all use of our Services.

Services

This Contract applies to all ARTLAS apps, websites, communications, and any other services that state they are offered under this Contract, including data collection related to these services.

ARTLAS

This Contract is with ARTLAS, the entity providing the service. It applies globally, with special considerations for users in the European Union (EU), European Economic Area (EEA), and Switzerland.

As a user, whether as a Visitor or Member, your personal data usage is governed by our Privacy Policy.

Changes to the Contract

We reserve the right to modify this Contract. Should significant changes occur, we will notify you through our Services or other means, providing you the opportunity to review the changes before they become effective. Continued use of our Services after such notification implies acceptance of the new terms.

Obligations

Service Eligibility

You affirm that you are of legal age to enter into this Contract and are at least 16 years old, or the age required in your country for lawful use of the Services without parental consent.

 

Your Account

Maintain the confidentiality of your password and account. Your account is personal to you, and you're responsible for its use.

 

Notices and Messages

You consent to receive notices and messages from us through our Services or provided contact information. Keep your contact details current.

 

Sharing

Your shared content may be visible to others. You have control over your privacy settings and who sees your content.

 

Rights and Limits

 

Your License to ARTLAS

You own the content you provide, granting ARTLAS a non-exclusive license to use it. Your privacy and control over your content are respected as outlined in our Privacy Policy.

 

Service Availability

We may change, suspend, or discontinue any service at our discretion. Prices for our services may also change.

 

Other Content, Sites, and Apps

Your interaction with content or services provided by others through ARTLAS is at your risk.

 

Limits

We reserve the right to limit your use of the Services for breach of this Contract or misuse.

 

Intellectual Property Rights

ARTLAS respects intellectual property rights and expects the same from you.

 

Disclaimer and Limit of Liability

ARTLAS provides its services "as is" without any warranty. Our liability is limited to the maximum extent permitted by law.

 

Termination

Either party may terminate this Contract. Certain obligations and rights survive termination.

 

Governing Law and Dispute Resolution

Disputes will be governed by the law of the location of ARTLAS's headquarters, unless you reside in a Designated Country, in which case local law applies.

User Agreement and EULA Acceptance

By accessing or using the ARTLAS application ("Application"), you affirm your agreement to be bound by the terms of this User Agreement, including any amendments thereto and any operating rules or policies that may be published from time to time by ARTLAS. This Agreement includes the End User License Agreement (EULA) associated with the Application, which is incorporated herein by reference. If you do not agree to be bound by the terms of this Agreement, you may not access or use the Application.

No Tolerance for Objectionable Content or Abusive Users

ARTLAS is committed to creating a safe and respectful environment for all users. We have a zero-tolerance policy for objectionable content and abusive behavior. Objectionable content includes, but is not limited to, content that is offensive, inflammatory, defamatory, pornographic, harassing, threatening, or otherwise inappropriate. Abusive behavior includes, but is not limited to, harassment, stalking, or any other actions that disrupt the experience of other users or undermine the integrity and functioning of the Application.

  • Responsibility for Content: You are solely responsible for the content that you post, upload, link to, or otherwise make available via the Application. You agree that your use of the Application will comply with all applicable laws, rules, and regulations and will not cause injury to any person or entity.

  • Enforcement: ARTLAS reserves the right, but does not assume the obligation, to monitor interactions within the Application and to remove any content that violates this Agreement or is otherwise objectionable. ARTLAS further reserves the right to terminate or suspend access to the Application for users who violate these terms or engage in abusive behavior.

  • Reporting Violations: If you encounter any content or behavior that violates these terms, please report it to ARTLAS immediately. We are committed to taking appropriate actions, which may include removing the content, suspending or terminating the offender's account, and/or reporting the behavior to law enforcement authorities as deemed necessary.

Your commitment to these terms is essential for maintaining a positive and welcoming environment in the ARTLAS community. By agreeing to this User Agreement and EULA, you pledge to uphold these standards and to foster respectful and constructive interactions within the Application.

ARTLAS COPYRIGHT POLICY

Artlas respects the intellectual property rights of others and prohibits users from uploading content that violates those rights. This policy outlines the procedures for reporting copyright infringement and submitting counter-notices.

User Agreement and Content Ownership

 

By using Artlas, you agree to our Terms of Service, which require that all content you upload is accurate, lawful, and does not infringe on the rights of others. You retain ownership of your artwork uploaded to Artlas.

Reporting Copyright Infringement

 

If you believe your copyrighted artwork appears on Artlas without your permission, you can submit a copyright infringement notice. To be valid, your notice must include:

  • Your Contact Information: Include your physical or electronic signature, email address, and phone number.

  • Identification of the Copyrighted Work: Clearly describe the artwork you believe is infringed.

  • Location of the Infringing Content: Provide a specific link or description of where the artwork appears on Artlas.

  • Good Faith Belief: State your belief that the artwork is used without your permission or legal authorization.

  • Accuracy Statement: Declare under penalty of perjury that the information in your notice is accurate and you are the copyright owner or authorized representative.

If you believe your artwork was removed due to a mistaken copyright infringement claim, you can submit a counter-notice. Your counter-notice must include:

  • Your Contact Information: Include your physical or electronic signature and contact details.

  • Identification of Removed Content: Specify the artwork that was removed.

  • Good Faith Belief: State your belief that the removal was a mistake or misidentification.

  • Consent to Jurisdiction: Agree to the jurisdiction of a specific court (as outlined in the template) to resolve the dispute.
